Privacy Policy
1. Information we collect
We collect personal information that you provide directly to us — name, business title, company, email address, phone number, mailing address — when you sign up for a trial, request a demo, subscribe to insights, contact us, or otherwise interact with the Site. We also automatically collect technical information about your visit, including IP address, browser type and version, operating system, referring URL, pages viewed, and timestamps, through standard web-server logs and the cookies described in our Cookie Policy.
For paid customers, we also process operational data you upload to the FreightMath platform — including general-ledger data, TMS transactional data, and other freight operational data. Our handling of that customer data is governed by your separate customer agreement and is not considered “personal information” under this policy unless it identifies a specific individual.
2. Legal bases for processing
Where the General Data Protection Regulation (GDPR) applies, we process personal information on one or more of the following bases: (a) your consent; (b) performance of a contract with you; (c) compliance with a legal obligation; or (d) our legitimate interests in operating, securing, and improving the Site and Services. Where the California Consumer Privacy Act (CCPA) or other U.S. state privacy laws apply, we process personal information for the business purposes described below.
3. How we use information
We use personal information to:
- Provide and operate the Site and Services.
- Process trial signups, demo requests, and customer onboarding.
- Send transactional and customer-service communications.
- Send insights, product updates, and marketing communications you have opted into (you can unsubscribe at any time using the link in any email).
- Analyze traffic patterns and improve the Site.
- Investigate and prevent fraud, security incidents, and abuse.
- Comply with applicable laws and respond to lawful requests from authorities.
4. Disclosure to third parties
We do not sell personal information. We may share personal information with:
- Service providers who help us run the Site and Services (hosting, analytics, email delivery, customer support). These providers are contractually required to protect personal information and use it only for the services they provide to us.
- FreightMath partners — including Nussbaum Technology (BidRight), MapLedger integration partners, and TMS vendors — strictly to the extent needed to deliver services you have requested.
- KSM affiliates, including Katz, Sapper & Miller and KSM Transport Advisors, for internal business purposes consistent with this policy.
- Legal and regulatory authorities, where required by law or in response to a valid legal process.
- A successor in connection with a merger, acquisition, or sale of assets, subject to confidentiality protections.
5. International transfers
FreightMath is operated from the United States. If you access the Site or Services from outside the United States, your personal information will be transferred to, stored, and processed in the United States. Where required, transfers from the European Economic Area, United Kingdom, or Switzerland are made under appropriate safeguards, including the European Commission's Standard Contractual Clauses.
6. Your rights
Depending on where you live, you may have rights to (a) access the personal information we hold about you, (b) request correction or deletion, (c) object to or restrict certain processing, (d) data portability, and (e) withdraw consent. To exercise any of these rights, contact us at privacy@ksmta.com. We will respond within the time frame required by applicable law.
7. Cookies and tracking
We use cookies and similar technologies on the Site. Categories used, third parties involved, and instructions for controlling cookies are described in our Cookie Policy.
8. Data security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls, and employee training. No method of transmission or storage is perfectly secure, and we cannot guarantee absolute security.
9. Retention
We retain personal information only for as long as needed for the purposes described in this policy, to provide the Services to you, to comply with our legal and regulatory obligations, and to resolve disputes and enforce our agreements.
10. Children
The Site and Services are not directed to children under 13 (or the equivalent minimum age in the relevant jurisdiction). We do not knowingly collect personal information from children. If you believe we have collected information from a child, contact us and we will delete it.
11. Changes to this policy
We may update this Privacy Policy from time to time. The most current version will always be posted at freightmath.com/privacy with an updated effective date. Material changes will be communicated by reasonable means.
